Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Start Fishing (“the app”), operated by an individual developer, Mike Adams. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.

The service

Start Fishing helps beginner shore anglers save fishing spots, get AI-generated bite forecasts (the “Bite Card”), identify catches and gear from photos, and keep a catch log. Some features are available for free; others require a Start Fishing Pro subscription, described below.

Accounts

You may create an account with an email and password, or sign in with Google or Apple. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and promptly update it if it changes. You can delete your account and associated data at any time from within the app.

Acceptable use

You agree not to:

• Use the app for any unlawful purpose or in violation of these Terms.
• Upload photos or content that are illegal, infringe others’ rights, or that you do not have permission to share.
• Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the app or its underlying systems.
• Use automated means to scrape or extract data from the app at scale.

Fishing regulations and safety

Start Fishing provides spot suggestions, bite forecasts, and identification results for informational purposes only. It is your sole responsibility to know and follow all local, state, and federal fishing laws and regulations, including licensing requirements, size and bag limits, seasons, and protected or restricted species and areas, for wherever you fish. The app does not verify regulations on your behalf.

You are solely responsible for your own safety, including near water, on rocks or jetties, in tides and currents, and in all weather conditions. Use good judgment and appropriate gear, and never rely on the app as a substitute for common sense or official safety guidance.

AI-generated content

Bite forecasts, recommendations, and photo identifications (of catches and gear) are generated using AI (Google Vertex AI / Gemini) and, when AI is unavailable, a deterministic fallback. These outputs can be incomplete, outdated, or wrong. Always use your own judgment, and verify species identification independently before making decisions that depend on it (for example, regarding protected species or whether a catch is safe to keep or eat).

Start Fishing Pro subscription

Start Fishing Pro is an auto-renewing subscription purchased through Apple’s In-App Purchase system and billed to your Apple ID. Unless canceled at least 24 hours before the end of the current period, your subscription automatically renews for the same duration and price you agreed to at purchase. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings > your name > Subscriptions on iOS). Refunds are handled by Apple according to Apple’s own policies, not by us.

Your purchase is also subject to Apple’s Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.

Disclaimer of warranties

The app is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or that forecasts or identifications will be accurate.

Limitation of liability

To the fullest extent permitted by law, Mike Adams and Start Fishing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the app — including reliance on any bite forecast, spot suggestion, or photo identification, or any injury or incident occurring while fishing. Our total liability for any claim arising from these Terms or the app will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

Termination

You may stop using the app and delete your account at any time. We may suspend or terminate access to the app for anyone who violates these Terms.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you within the app. Continued use of the app after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles.
